What are IEEPA Tariffs?

The IEEPA tariffs layered new import duties on top of existing tariffs between February 2025 and February 2026. Although now invalidated, the refund process is not automatic. IEEPA tariffs are tariffs imposed under executive orders that relied on the International Emergency Economic Powers Act as the source of authority. Courts later held that IEEPA did not authorize those tariffs.

Did the Supreme Court strike down IEEPA tariffs?

Yes. On February 20, 2026, the U.S. Supreme Court held in Learning Resources, Inc. v. Trump that IEEPA does not authorize the President to impose tariffs.

Are IEEPA refunds available?

A refund process has been taking shape after the Supreme Court’s ruling. Skadden reported that the Court of International Trade ordered refunds of approximately $165 billion in unlawfully collected IEEPA duties, and Reuters reported that CBP was building a system tied to about $166 billion in collections.

How much could IEEPA refunds total?

Public estimates vary. Penn Wharton Budget Model projected up to $175 billion in refunds, while CBP and post-ruling reporting have referenced a refund system for roughly $165 billion to $166 billion in unlawful collections.

When did the IEEPA tariffs start?

The major challenge IEEPA tariff actions began on February 1, 2025, with additional reciprocal tariffs imposed on April 2, 2025.
