Tariff recovery is the broader process of identifying, pursuing, and recovering refundable customs duties and tariffs. This can include:
IEEPA tariff refunds,
customs protests,
import duty recovery,
drawback claims,
and tariff-related litigation.
Many U.S. importers are now reviewing past customs entries to determine whether they may qualify for tariff refunds.
IEEPA tariff refunds involve duties imposed under the International Emergency Economic Powers Act (IEEPA). Recent court developments have created potential refund opportunities for certain importers that paid qualifying tariffs between February 2025 and February 2026.
Industry estimates suggest that more than $175 billion in potentially recoverable duties may be involved.
No. Tariff refunds are generally not automatic.
Most importers must take affirmative action to pursue recovery, including filing customs protests, reviewing entry records, submitting documentation, and complying with procedural deadlines.
Many businesses mistakenly assume the government will automatically issue refund checks, but that is typically not the case.
Phase 1 currently applies only to certain qualifying entries.
More complicated customs entries may fall into a future “Phase 2” process that does not yet have a confirmed implementation timeline.
This is important because many importers incorrectly assume all tariff refunds will be processed immediately.
